LocTrac Service Terms and Conditions

The Loctrack service is in BETA testing period.

Use of the LocTrack service requires the creation of an account. This allows users to share position data with other user registred of this service. Each user can request access to position data of another user. Once access is granted, position data will be accessible. The account must belong to a real person. Fake accounts or accounts with invalid address entries will be deleted without further notice.

Requesting an account and using this non commercial service is free of charge during this BETA period. All accounts may be deleted after the BETA period. Usage of the LocTrack service for direct or indirect commercial purposes without written permission by PCCON is prohibited.

Additional fees will apply when downloading the Windows Phone 7 LocTrac App even during BETA period. The Application is available through the Microsoft Marketplace and fees incurred are non refundable. The Windows Phone 7 application can be used without the LocTrack service however with limited functionality (sending position data via email only). PCCON can not be held liable for damages or illegal action by the user incurred due to the direct or indirect use of this product (service/application).
 
The Phone application will automatically send position and Phone identification data to the LocTrack service. No such information can be obtained by another user without permission being granted. Additional costs may be applied for the data communication and internet access of the phone. This depends on the individual data service plan of the phone.
 
The LocTrack service operated by PCCON will not sell or forward any of this information which would facilitate a third party in the tracking of individual persons.

Liability for Content

Nevertheless, we shall safeguard your data, subject to this limitation. Accordingly, as the Web site provider, we shall not be held liable for any damages incurred as a consequence of such security risks or for any related acts of omission on our part.

We oppose the use of any available contact information by a third party for sending unsolicited advertisements. As the Web site provider, we reserve the express right to take legal action against unsolicited mailing or e-mailing of spam and other similar advertising materials.
